I've been told that the title company should have provided you with the deed restrictions when you closed on your house. I can say that I'm on my second house, and neither title company provided this information. On a good note though, if you call your title company, they should be able to get you a copy. I called my title company months after I moved in and they faxed me a copy.
In regards to who enforces deed restrictions, I have been told that it is ultimately up to the neighborhood to enforce the rules. Essentially, what this means is that if you have one neighbor breaking the rules, you can get the rest of the neighborhood to formally sign a complaint and present this to that individual. If that doesn't work, I think you then have to get an attorney involved, if you can figure out how to pay that expense. Typically pointing out that they are breaking the deed restrictions in your neighborhood is enough to stop whatever the problem is. However, I can say that I have a few people pushing the boundaries of the deed restrictions in my neighborhood as well. One thing to keep in mind is that some of your deed restrictions might be in line with city ordinances as well so you might be able to get the city involved depending on what the issue is.
